Getting Started: How to Prepare for Your Case with Us

If you’re considering taking legal action in China and would like our team to assist, here’s a quick guide on how to get started. Don’t worry if you don’t have everything ready yet, our team will support you at every step to ensure a smooth and effective process.

Step 1: Initial Document Preparation
To help us understand your case and begin preparing, we recommend gathering the following documents:
1. Basic Company and Identity Documents
• Your company’s business license or registration certificate
• A copy of the legal representative’s passport
2. Key Documents Related to the Dispute (if available)
• The sales contract or agreement
• Proforma invoice
• Payment records (such as bank transfer slips)
• Any evidence of the other party’s breach (e.g., emails, delivery failure, refusal to refund, etc.)
If you feel these documents don’t fully reflect what happened, that’s completely fine. We’ll work closely with you to identify and collect any additional materials needed.
Step 2: Authorization Documents
After confirming your payment, we will provide you with a set of authorization documents that need to be notarized and legalized (Apostilled) in your country. These documents are required by the court in China.
You will typically need to notarize and legalize the following:
• Your company’s registration certificate
• Certificate of the legal representative (we will provide the format)
• Passport copy of the legal representative
• Power of Attorney (also provided by us)
Step 3: Parallel Preparation
While you are arranging the notarisation and legalisation, our legal team will begin working on your case in parallel. This includes:
• Drafting the Statement of Claim
• Reviewing and organizing the supporting evidence
• Discussing the option of property preservation (asset freezing), if applicable
You’ll receive both English and Chinese versions of the Statement of Claim to review. Once confirmed, please courier the signed original Statement of Claim and the legalised authorization documents to us.
Step 4: Translation & Case Filing
Once we have all required documents:
• We will organize certified translations for all non-Chinese materials and obtain a quote for your approval
• After translation and internal review, we will submit the case to the appropriate court in China
Step 5: After the Case Is Filed
Once the court accepts the case, it will inform us of:
• The case number and judge
• The official court fees
• The next procedural steps
